Breeding Agreement

1.       I (We) understand and agree that the mare shall be in healthy and in sound breeding condition and that a veterinarian’s certificate shall accompany the mare. Failure to furnish this will automatically authorize the Stallion Manager to have the mare examined at the expense of the Mare(s) owner.

2.       Mares that are not halter broken will not be accepted.

3.       I (We) understand and agree that the Stallion Owner, Manager or any of the staff will not be responsible for accident, sickness or death to the above stated Mare or to any foal. It is also understood that the mare owner/handler(s) will not be responsible for any disease, accident, or injury to the Stallion.

4.       I (We) do agree to pay to the Stallion Manager:           

        a.        $ ________________ Booking Fee,

        b.       $ ________________ Breeding Fee,

        c.        $_________________per day Mare Care (wet), $ ________________ Mare Care (dry).

        d.       All fees totaling $ ________________________ ,

        e.       to be paid in full by _______________________.

5.       If the aforementioned fees are not paid, the Stallion owner reserves the right to assert a breeder’s lien. All cost incurred collecting delinquent charges shall be the responsibility of the Mare owner. These costs include but are not limited to the following: court costs, attorney fees, skip tracing. The signing of this contract entitles The laws of the State of Missouri govern this agreement. All accounts are due and payable in Jefferson County, Missouri in U. S. Dollars.

6.       A photostatic copy of the mare’s registration papers (both sides), shall be sent to the Stallion Manager with this contract. A current Coggins test (or photostatic copy) shall accompany the mare.

7.       Should the above named stallion die or become unfit for service, this agreement becomes null and void. The booking fee and mare care is considered earned if the mare is in the Stallion Manager’s care and will not be refunded. The balance of breeding fee will only be refunded if the mare is not successfully bred at time of stallion’s death during the same breeding season. All other guarantees become void in the event of the stallion’s death or he becomes unfit for service.

8.       The Stallion Manager agrees to diligently try to settle the above mare and shall have sole discretion of determining the best method of breeding the mare. If, however, the mare does not settle, the Stallion Manager/Owner  shall be held harmless.

9.       Live Foal Guarantee: Live foal means the foal shall stand and nurse. It is understood that if the mare proves barren, aborts her foal, or if foal is still born, a return season will be guaranteed for the following year only, providing proper notification is given. Mare owner certifies that such abortion or death did not result from any act or omission of the Owner subsequent to the mare’s departure from the breeder. Booster rhinopneumonitis vaccinations must be administered as indicated by the drug manufacturer as the mare progresses through pregnancy. Failure to do this will void the live foal guarantee.

10.    Third year rebreeds will be subject to an additional booking fee plus any increases in breeding fee. No live foal guarantee will be granted on the third year rebreeds. Rebreed request must be accompanied by a veterinarian’s certificate stating the mare is healthy and in sound breeding condition.

11.    The breeding season in force for this contract shall begin February 1 and close July 15 of the year dated on this contract.

12.    A breeder’s certificate will be issued to the Mare owner after all expenses have been paid in full and upon notification of birth of the foal.
